The timeline of events has become central to the growing controversy. According to attorney Tyler Cox, the group arrived at Horn Island shortly before 11 in the morning. They spent the day enjoying the holiday festivities alongside hundreds of other boats and thousands of visitors. The last confirmed sighting of Wells by Hudson occurred around 3 in the afternoon.

“They had this little comedic moment because at the time Nolan was kind of holding and cradling a girl that he had met on the island,” Cox explained. “You know him being one of Nolan’s best friends, Warren kind of gave him kind of a chuckle, like, ‘Oh, I see you with this girl.’ You know, ‘Hope everything goes well for you.'”

Approximately an hour later, complications arose with the Triton, one of the boats in their group. The bilge pump malfunctioned, causing water to rise rapidly within the hull—nearly submerging the battery. Panic set in as the friends realized they needed to depart immediately.

“They left the island at 4:30 pm … So, we don’t know what happened to Nolan after 4:30,” Cox stated. “We want to know just as much as anybody.”

Conspiracy Theories Take Root

The departure has sparked numerous theories about what transpired next. Some community members have assumed Wells was abandoned on the remote island without access to communication or assistance. However, Cox emphasized that this scenario is unlikely given the circumstances.

“That’s just how it is here. You can always find another ride off the island, and again, there were 2,000 other people there, so he wasn’t left alone by any means,” Cox noted.

Another point of contention involves Wells’ cell phone, which was reportedly on the boat when the group departed. Cox explained that it is standard practice to anchor fifty feet offshore and swim to shore, a process that exposes phones to saltwater. When the group returned, they collected all the phones aboard—including five others besides Wells’. The device was later tracked to a friend’s residence.

Legal Action and Public Scrutiny

Defamation attorney Edward Paltzik, who also represents the three men, has criticized the way edited audio from an emergency tow call has been circulated online. He described the audio as a distraction from the core issues surrounding the case.

“The Sea Tow call — and the hundreds of versions of it now circulating — is a red herring. It’s distracting people from what matters,” Paltzik said.

CNN obtained and reviewed the same audio recording and determined it to be inconclusive regarding the allegations. Paltzik indicated that the legal team is focusing on pursuing claims against those with the largest platforms who have made the most damaging statements.

“We’re winnowing it down to the worst of the worst – the worst of the worst offenders who have said the worst things, who have the largest platforms, who have caused the most damage,” Paltzik explained. “It’s going to be a lengthy process.”

For Hudson, Pitalo, and Seymour, the situation presents a dual burden. They must process the loss of a friend they have known since middle school while defending themselves against accusations and threats. Cox summarized the situation succinctly.

“The biggest tragedy of this entire thing is that Nolan unfortunately lost his life and nobody knows definitively what happened,” Cox said. “These guys haven’t been able to mourn the loss of their friend and brother Nolan Wells.”
